1. Introduction
Welcome to HalcyonPublicWay ("we," "our," or "us"). These Terms & Conditions ("Terms") manage your use of our yacht charter services and website available at halcyonpublicway.sbs (the "Service") operated by HalcyonPublicWay.
By reserving a yacht or using our Service, you consent to comply with these Terms. If you do not accept any part of these terms, you are not permitted to use the Service.
2. Service Overview
HalcyonPublicWay offers high-end yacht charter services, which include:
- Daily yacht hires
- Evening cruises
- Business getaways
- Exclusive gatherings
- Extended charters
All offerings are contingent upon availability and favorable weather conditions. We reserve the privilege to alter or cancel services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To reserve a yacht, you must:
- Be at least 18 years in age
- Present precise and thorough information
- Submit the necessary deposit as laid out in your reservation confirmation
- Conform to these Terms & Conditions
3.2 Confirmation
A booking is only solidified with the payment provision and our issued confirmation. We maintain the discretion to refuse service to anyone at will.
3.3 Availability
Yacht charters are dependent on the availability of the vessel and appropriate weather conditions. We will strive to accommodate your preferred timings and dates.
4. Payment Terms
4.1 Pricing
All price estimations are given in € and encompass relevant taxes unless noted otherwise. Rates are amendable without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the entire charter cost, due at the time of reservation
- Final Payment: Due 48 hours before the yacht departure
- Supplementary charges (if applicable): Payable following the charter's conclusion
4.3 Payment Methods
We accept prominent credit cards, direct bank transactions, and authenticated cheques. Payments are processed via secure, encoded methods.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours prior to departure: Complete refund minus processing fees
- Between 24-72 hours before departure: Half refund
- Within 24 hours of departure: Non-refundable
5.2 Weather Cancellations
In case the captain deems weather conditions as hazardous, we will propose either:
- Rescheduling the charter at no extra cost to an alternative date
- A full refund if rescheduling is not feasible
5.3 Mechanical Problems
If mechanical failures occur with the designated vessel, we will endeavour to provide a comparable replacement. If no substitute is accessible, we will issue a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Adhere to all instructions from the crew
- Use safety equipment when mandated
- Disclose any medical issues that may impact their safety
- Stay within the allowed areas on the vessel
6.2 Prohibited Items
Passengers are prohibited from bringing aboard the following:
- Glass receptacles
- Unlawful substances
- Weapons or firearms
- Excessive alcoholic beverages (beyond moderate consumption)
- Pets (except if pre-authorized)
6.3 Behavior
Passengers are expected to behave respectfully. We retain the right to terminate a charter prematurely without reimbursement if a passenger's conduct is deemed a safety threat or interrupts the excursion for others.
7. Liability and Insurance
7.1 Our Responsibility
Our accountability is restricted to the amount paid for your yacht rental. We disclaim responsibility for:
- Injuries incurred due to passengers' negligence
- Theft or damage to personal belongings
- Secondary, incidental, or punitive losses
- Delays resulting from weather or scenarios outside our control
7.2 Coverage
We uphold expansive marine insurance that covers our vessels and business operations. Clients are accountable for securing their own travel and personal insurance.
7.3 Risk Acceptance
By engaging in our charter offerings, you accept that marine activities carry intrinsic hazards, and you take responsibility for your personal safety and health.
8. Alterations and Itinerary Adjustments
We reserve the authority to alter itineraries, routes, or timelines due to weather concerns, safety reasons, or operational demands. We will endeavor to provide similar alternatives when changes are made.
9. Force Majeure
We are exempt from liability for interruptions, cancellations, or changes induced by factors beyond our control, including:
- Extreme weather scenarios
- Natural catastrophes
- Regulations by authorities
- Shutdowns of ports
- Equipment breakdowns
10. Privacy and Data Protection
Your personal data is processed in compliance with our Privacy Policy. By patronizing our services, you consent to our data collection and usage as outlined in the Privacy Policy.
11. Intellectual Property
All material found on our website, such as texts, visuals, logos, and images, is shielded by copyright and trademark laws. Unauthorized reproduction, distribution, or derivation of works is not permitted without our consent in writing.
12. Jurisdiction
These Terms are regulated by the laws of Spain. Any conflict will be adjudicated in courts situated in Barcelona, Spain.
13. Terms Revisions
We claim the right to amend these Terms as needed. Any modifications will be posted with a new version date on our website. Continued utilization of our services implies agreement to the revised terms.
